Appeals Court Upholds Damages for Wal-Mart Worker
The 2nd Circuit Court of Appeals has upheld a $900,000 award for compensatory and punitive damages, plus $644,000 in attorney fees to a disabled Wal-Mart employee. The appellate court found that Wal-Mart should have made accommodations for an obvious disability even though the worker did not request any. Such claims made under the Americans with Disabilities Act are usually triggered by an employee’s request for accommodations. Mark Hamblett, Law.com 07/08/2008
