U. S. House Begins Debate on Bill to Overturn Supreme Court Ruling on Medical Devices
The House heard testimony this week on the Medical Device Safety Act of 2009, laying the groundwork for yet another debate over tort reform. The new bill would overturn the Supreme Court’s 2008 ruling in Riegel v. Medtronics, Inc. which prevents patients injured by FDA approved medical devices from seeking damages in state product liability suits. The American Association of Justice contends that the bill would restore victim’s rights. (5/14) Law.com
